Colorado Wrongful Death Laws

Under Colorado law (C.R.S. § 13-21-201), a wrongful death occurs when a person’s death results from the “negligence, unskillfulness, or criminal intent” of another party. The purpose of a wrongful death claim is to compensate surviving family members for the personal and financial impact of their loss.

Colorado’s wrongful death statute limits who can bring a claim and when. For example, during the first year after death, only the surviving spouse may file (unless they transfer that right to or with the deceased’s children). In the second year, more people become eligible.

Recoverable damages in a wrongful death case may include:

  • Lost income and benefits the deceased would have earned
  • Funeral and burial expenses
  • Loss of companionship
  • Pain and suffering

In addition, Colorado allows for a survival action, which compensates the deceased person’s estate for losses they experienced before death, such as medical bills and lost wages.

A wrongful death claim is civil, not criminal. This means that even if criminal charges are never filed (or result in an acquittal), you may still win compensation in civil court under a lower burden of proof.

Who Can File a Wrongful Death Claim in Colorado?

Taking legal action after the loss of a loved one is an essential step, but there are limitations on who can do so. The surviving spouse of the victim has the exclusive legal right to file a lawsuit in a case like this. They have the exclusive right to do so during the first year. The spouse can allow children or other descendants to join the suit in writing.

In the second year, children and spouses can file a claim. In situations where there is no spouse or child, the parents can file a wrongful death lawsuit. There are additional situations where other parties may gain the right to file. In January of 2025, the law was updated to allow for siblings to file a wrongful death lawsuit only in situations where there is no spouse, child, or parent to do so. How Long Do I Have to File a Wrongful Death Claim in Colorado?

The statute of limitations in Colorado for wrongful death is typically two years from the date of death. There are some situations where this timeframe may extend. For example, if it is not clear that the incident was a wrongful death due to hidden or withheld information, the discovery rule may extend the time you have to file a lawsuit.

There are some exceptions to this rule. In a hit-and-run accident, the statute of limitations is extended to 4 years.
